Knutson  and Judge Karen Asphaug. From Volpe: “The judges in Sandra Grazzini-Rucki’s criminal and family court case may have previously fixed cases for her ex-husband, raising further doubts about the fairness of their rulings.

In one incident, Judge Karen Asphaug presided over a criminal charge of disorderly conduct against David Rucki.

The charge resulted after an incident on September 8, 2009, where Rucki was arrested after becoming aggressive and threatening towards his neighbors. According to the complaint,”He stated the suspect (Rucki) threatened his wife, his son, then called them all assholes…

A juvenile victim reported that Rucki called her mother “a crazy lady” and “a stupid bitch“. And said Rucki threatened,”If any of you assholes ever call the police on me again, I’ll raise holy hell.”

Another juvenile victim reported that Rucki threatened him and swore at him, call him a “little son of a bitch“.

According to witness statements, Rucki’s behavior was escalating to a frightening level. David Rucki thinks “asshole” is an appropriate term for a three year old.

The same neighbor filed for a harassment order  after this incident HRO Filed Against Rucki 2009 and then installed security cameras around his home.

This image below was taken from additional security cameras that ex-wife Sandra Grazzini-Rucki had installed around her home, capturing on numerous occasions where Rucki was stalking and harassing Sandra and children. Even after a protect order was filed, Rucki would not stay away…. or abide by the law.

The police report also suggests that Rucki knew that he he could avoid criminal charges in court.  Rucki’s behavior indicates that he really does think that he is above the law – above any consequences. All of this is happening before Rucki ever sets foot in court.

Back to the police report:

Officer Michelle Roberts writes in her report,”Suspect (Rucki) told me that he didn’t have to listen to me. I advised him that if he would not allow me to question him regarding the specifics, I would have no choice but to charge him with disorderly conduct based on their allegations.

He stated,’Go ahead, it’s their word against mine and you can’t prove anything.’

I told him I would mail him a citation for disorderly conduct and he would have the opportunity to give his side in court. He responded,’I’m not going to show up for court, this is bullshit.’  He then said,’You guys can get the fuck off my property.’ Suspect approached us two additional times, each time arguing that we couldn’t take their word over his.

In a supplemental report written by Officer Barb Maxwell, she took a complaint from the neighbor regarding Rucki’s frightening behavior towards his family. Officer Maxwell notes that when she attempted to speak to Rucki, he “..tried to intimidate me. I introduced myself and stated,’I am here because of a complaint on your dogs.’ Rucki got very close to me and said,’There is NO complaint on my dogs‘, and from that point on I was unable to say another word.” Rucki then went on to refer to the neighbor as a “bitch” when speaking to the police.

Where is Rucki’s attitude coming from? Is this the typical mentality of an abuser or is there something more.. is someone protecting Rucki from within Dakota County,  the legal system?

 The disorderly conduct case came before Judge Karen Asphaug, on 12/31/2009 when a preliminary hearing was held. A trial date was then set. But before the case could go to trial, the defense filed a motion to dismiss for “lack of probable cause.” That motion was granted without a hearing by Judge Asphaug and the case was abruptly thrown out.

 

How could there be “lack of probable cause” when witnesses to the crime included police officers? When there would be physical evidence such as dog feces and paw prints in the neighbor’s yard? When there were multiple witnesses? When an HRO was granted? When Rucki was making comments to police that implicated himself in the crime?

 That Judge Asphaug presided over this prior disorderly conduct case  against Rucki should have disqualified her from later presiding over the criminal case of Sandra Grazzini-Rucki. That Judge Asphaug had knowledge of an incident involving a criminal charge against Rucki, where he was accused of violent behavior, creates a conflict of interest.
Further, this incident with the neighbor should have been allowed as evidence at Sandra’s criminal trial. The neighbor had also written letter to describe his experiences with Rucki,”In our near decade of living next to him I have found him to be a very angry individual rages at anyone who has contention or confronts him. It got so severe against our family that the court awarded us a restraining order in September 2009….
As police reports can verify, he has boldly cursed profanely at, and tried to intimidate Lakeville’s female animal control officer. It is logical to conclude he is capable  of more towards those more vulnerable, such as his wife and children.victimletter
Instead, Judge Asphaug suppressed this evidence from the jury in the criminal trial of Sandra, forcing the jurors to find her guilty of parental deprivation because without evidence, the defense was not allowed to effectively argue it’s affirmative defense. Judge Asphaug also concealed her prior involvement with Rucki, and that she dismissed the disorderly conduct charges under unusual circumstances.
Judge Asphaug suppressed other evidence in the criminal trial of Grazzini-Rucki, including (Volpe):Although Rucki had appeared before this judge charged with violating a restraining order, however, the jury was never informed of this. That’s because the judge disallowed any mention that anyone ever took out a restraining order against Rucki when, in fact, four separate restraining orders were successfully taken out against Rucki. Ironically, Judge Asphaug also disallowed any mention of Rucki’s long criminal record as well as letters written by the children involved.

If that were not outrageous enough, Judge Asphaug refers to David Rucki again and again in the criminal trial as the victim, and in heavily sympathetic terms.
Victim? David Rucki is clearly a man who has demonstrated a propensity towards violence. He violates protective orders. He threatens his family and neighbors. And has tried to intimidate police… and more… David Rucki is NOT a victim. He is a dangerous predator.

In 2011, Judge David L. Knutson ordered the five Rucki children into reunification therapy and supervised visits with father, David Rucki, while two separate harassment orders were in place against him (one harassment order filed by Sandra, the other filed by a neighbor).

The danger Rucki poses to children is noted in a police report filed against Rucki prior to obtaining the HRO which states,”he and his wife run a daycare at their home and are very concerned for the children they care for (due to Rucki’s threats and aggressive behavior).

Along with the HRO, Rucki has a long history of violent behavior that manifests in both his criminal record, and in the abuse allegations raised by ex-wife Sandra Grazzini-Rucki and children. druckipolicereports (See page 11-21 for information related to this article) Court documents also indicate that Rucki was ordered in anger management classes on 3 separate occasions, and during the divorce was ordered into domestic abuse counseling.

Despite overwhelming evidence, Judge David L. Knutson refused to acknowledge the abuse, and has put the lives of the Rucki children at risk by first by court-ordering the “de-programming” the children to recant abuse allegations and then by giving sole custody to Rucki – after proven to be dangerous, emotionally unstable, and not safe around children.

The harassment order was filed by a neighbor R.M. (issued on September 15, 2009) and barred Rucki from having any contact with his wife R.R.M., their two children and even the children enrolled in the daycare they operated. HRO Filed Against Rucki 2009

According to the HRO David Rucki terrorized the family in the following ways:

Made Threats:He said he would unleash holy hell if we ever turned him in again”. “He also did a threat later in the street. He’s mad we called animal control over his dogs.”

Exhibited Frightening Behavior: Loud, Cursing, Coming in Close proximity to their house and mailbox.

Called the Victim(s) Abusive Names: Called my wife a “bitch” and my son a “son of a bitch” and called us “assholes”. Cursing at us while daycare kids present.

While the HRO was in place, Rucki violated the order numerous times. The neighbors were so frightened that they placed security cameras around their home.

The HRO remained in place for 2 years – the reason the neighbors did not renew the HRO was because Sandra had a protective order in place that prohibited David from coming near the cul-de-sac, where the neighbors also lived, so they felt that restraining order would also protect their family. This proved to be false – Rucki has stalked Sandra, and violated protective orders she filed against him. Sandra’s protective order was later dismissed by Judge David L. Knutson.

Journalist Michael Volpe, covering the Grazzini-Rucki case, just released a police report filed by R.M on September 8, 2009 . The police report documents the terrifying incident that led up to the HRO: David Rucki thinks “asshole” is an appropriate term for a three year old.

The police report demonstrates abusive behavior, and an abusive mentality through Rucki’s own words and actions. A pattern also emerges from the police report that corroborates abuse allegations raised by Sandra.

Domestic violence is defined by a pattern of abusive behavior that is used to gain power and control over another person through threat, force, violence or intimidation. Domestic Violence – US DOJ

What is particularly dangerous about Rucki is that he attempts to exert power and control over anyone close to him -beyond his family. Rucki literally prowls the neighborhood, and by extension Lakeville, as his own territory much like an alpha wolf.

A Few Examples of David Rucki’s Pattern of Abuse:

The police report describes Rucki threatening and swearing at the neighbor’s children and also swearing at the children in the daycare.

Rucki threatened and swore at the neighbor’s wife, R.R.M.; including incidents where children were present. Rucki is so brazen that he referred to R.R.M. as a “bitch” while police were present!

The threats and profanity are the same as what Rucki has said to Sandra, and his own children. The viciousness of Rucki’s words were captured in a series of voice mail messages left for his teenage son (Comments taken from picture above. Also read transcripts recorded voice mail messages)

Rucki refers to R.R.M. as a “crazy lady“. Rucki also accuses ex-wife Sandra as “crazy”. Sandra has never been diagnosed with mental illness. Rucki continues to avoid questions about his own mental health, and the results of his psych evals.

Rucki admits in the police report that he called Child Protective Services on the neighborsdue to safety concerns for the children“. Reading the police report it is obvious the only safety concern that exists is David Rucki. It is clear Rucki made a false report to CPS because he was angry at the neighbors, and was carrying out on threats he made against them.

Rucki made false reports against Sandra to the family court professionals and during the criminal trial, claiming she is a danger to the children. There have never been any findings of abuse against Sandra. Just the opposite – when court proceedings began, the Rucki children  expressed they shared a loving relationship with their mother and wanted to live with her. It is only through forcible separation, and under the threat of de-programming that has Sandra become estranged from her children.The allegations Rucki raised against Sandra are not motivated by genuine concern but rather, are a form of abuse.

Another example – while the police officer was interviewing R.M. (quote),”he informed me that suspect (Rucki) drove by as we were speaking and put up the middle finger of his left hand at him…” Rucki later admits to police that he did make a gesture but says, “I only waved at them, they can see it however they want.

Finally, when the police interview Rucki he is angry and refusing to cooperate. The officer informs Rucki that they will have to charge him with disorderly conduct, Rucki replies, “Go ahead it’s their word against mine and you can’t prove anything.” Rucki approached police two additional times stating “that we couldn’t take their word over his“. Rucki attempts to intimidate police to get them to drop charges against him.

In another section, Rucki basically says the laws do not apply to him. He attempts to intimidate another police officer into dropping a complaint against him.

You can’t prove anything” could also explain what has happened to Sandra throughout all of the legal proceedings from 2011 to the present – Dakota County, has taken the word of David Rucki as fact and completely violated the law, and dismissed significant evidence and documentation in doing so.

Judge Karen Asphaug “Encouraged Lawlessness” Sandra Grazzini-Rucki Turns Herself in After Warrant Issued

Dakota County issued an arrest warrant against Sandra Grazzini-Rucki, in connection with an alleged probation violation for failing to maintain contact with the probation officer. Sandra voluntarily turned herself in tonight after discovering a warrant had been issued, and is now in custody.

These sad events happened on the birthday of Sandra’s daughter, a subject of this criminal case who ran away in April 2013 from an unsafe home. The daughter has been unable to see or contact her mother in any way. – A mother who once was her primary caregiver, and whom she wanted to live with before the Courts condemned her to live with an abuser. The daughter wrote a letter stating the reason why she ran away, that included, “We fought back, begging them not to put us in the care of Tammy that we were afraid for our lives, and told them that Tammy and my father had abused us. But they didn’t care.” Another of the Rucki children also reported that Tammy abused her to the Lakeville police, who failed to make a mandatory report. Judge Karen Asphaug, and ADA Kathryn Keena are now claiming Tammy Love and David Rucki are “victims” to the detriment of the children – who are the REAL victims in this case.

The outrageous legal antics of Judge Karen Asphaug instigated these recent developments, in what can only be described as a circus – a waste of precious law enforcement resources, at tremendous expense to the tax payers of Dakota County. Many in the judicial system outside of Dakota County have expressed shock at how the Grazzini-Rucki case has been mishandled, and expressed concern over the amount of power a judge can exert over people’s lives, and how easily that power can be abused.

Under Minnesota law, the maximum time allowed under sentencing guidelines for felony deprivation of parental rights is up to 1 year and 1 day in prison. Sandra stepped forward, asked to finish her sentence in prison, and complete her sentence so she can then return to her home, out of state. All avenues kids to see or maintain contact with her children have been blocked, so that is not an option for Sandra.

Supporters of David Rucki demanded that Sandra be sent to prison, multiple comments posted online demanded prison. However, during sentencing, Judge Karen Asphaug issued an unusual sentence that involves a lengthy probation period of 6 years with yearly stints in jail, in addition a yearly requirement of sentence to serve, excessive monetary fines, compliance with all 3,400 family court orders issued by Judge David L Knutson and additional conditions that are impossible to afford financially or not humanly possible to comply with.  Judge Asphaug implemented this unusual sentencing after ADA Kathryn Keena asked for an aggravated sentence but was not allowed to inflict a harsher sentence, than the law allowed, because the nature of the crime did not meet guidelines. Sandra immediately asked to execute her sentence, as this was the only feasible option, and later was given a hearing.

The cost to tax payers to for the cost to jail Sandra, and enforce a lengthy probation is astronomical. According to a recent study, “...The average annual income of every Minnesota resident is roughly equal to the average annual cost per inmate in our prison system.”  Average Annual Cost of Minnesota Prisons: $41,364 Per Inmate in 2010 by Jay Carey

The expenses incurred on Sandra alone could easily double that figure, and would be better spent elsewhere in the criminal justice system. Sandra Grazzini-Rucki poses no danger to society, and is willing to do her time in prison and complete her sentence. The only obstacle to a resolution in this case is Judge Asphaug, who insists on a punishment that is both cruel and unusual.

If Sandra were to be jailed in the Ramsey County Workhouse, the cost is paid for by the tax payers of Dakota County. The cost to house an inmate in the Workhouse is an estimated $70 per day, already Sandra has served 170 days there – so far Dakota County spent close to $12,000 to incarcerate her. If Judge Karen Asphaug sends Sandra back to the Workhouse she could waste up to $17,000+ of Dakota County tax payer’s money. However, if Sandra were allowed to execute,and were sent to prison the cost wound be reimbursed through federal funding, and the case would be quickly resolved. All of these extraordinary measures are directed toward a non-violent offender who poses no risk to the community. Sandra’s only “crime” is protecting her children from abuse after multiple levels of the system (family court, police, court ordered therapy, CPS, juvenile court/CHIPS petition etc.) ignored the Rucki children’s cries for help.

The family court system, led by Judge Knutson, used force and intimidation to order the Rucki children into the custody of the abusive father, who they feared.  The abuse that happened is effectively being covered up.

Sandra’s former criminal attorney, Stephen Grigsby, previously argued for an executed sentence during the September 21st hearing– meaning Sandra would serve her entire sentence in jail. Grigsby stated to the court, that refusing her this right would “encourage lawlessness” and “dare” Sandra to violate probation.

The defendant in the above-entitled matter hereby moves the Court to execute her sentence.

ARGUMENT

Not withstanding the provisions of 609.135, subd. 7, which purports to deny the defendant the right to execute a sentence, the right inheres in the basic ability of a defendant to demand, either by a formal demand or a deliberate violation of probation.

The latter (violation of probation) encourages lawlessness and wastes time and resources.

Eventually a probationer can assure the execution of a sentence by refusing to comply with probation and it therefore makes no sense to dare her to do so when there is a desire to refuse to comply with probation and serve her executed sentence.”

During the hearing, Judge Asphaug waltzed into court, waving a paper to show that she had found a case that would justify her reasons to refuse prison. She promptly imposed probation on Sandra.The case cited did not match any of the circumstances in the Grazzini-Rucki criminal trial. Judge Asphaug then denied the motion to execute her sentence. Grigsby responded, “This was really an irrational act by the court.”

If Sandra had been allowed to execute her sentence, she would serve up to 8 months in prison, and then be released having completed her sentence. Isn’t that the purpose of the criminal justice system? Have a defendant serve their time, and return to society as a law abiding citizen? What Judge Asphaug is doing is NOT promoting justice.

After sentencing, Sandra was immediately taken into custody, and served an additional 34 days in the Workhouse then was released into probation on October 24th. Allegations of a probation violation followed soon after.

Sandra’s criminal conviction resulted after Sandra courageously fought to protect her children from abuse. When the courts, CPS, and police failed to protect them, two of the oldest Rucki girls ran away. Sandra’s role in assisting her teen daughters is not an act of a criminal – but is the actions of a mother who “reasonably believed the action taken was necessary to protect the person taking the action from physical or sexual assault” and raised this affirmative defense during her criminal trial. Minn. Statute 609.26 – Includes Affirmative Defense Judge Asphaug suppressed 75% of defense evidence, blocking Sandra from presenting the affirmative defense to the jury, that would prove abuse did occur.

Sandra Grazzini-Rucki is not a hardened criminal, not a danger to society or to anyone else. Just the opposite – Sandra is a loving mother of 5 children, was an active volunteer at school events and PTA, was an enthusiastic community volunteer (working on projects throughout the state of Minnesota) who was always willing to help others with a generous and sincere heart, former Mrs. Lakeville and a respected flight attendant of 30+ years with a spotless record.

Sandra’s life has been completely destroyed after seeking a divorce from a wealthy, well-connected abuser, David Rucki, who has misused the court system to further abuse her, and exact revenge. Everything Sandra loved, everything that was important to her life, has been brutally taken from her – her children, her extended family, her home, all of her belongings (even her clothing and toiletries taken by court order), her financial stability, her career – and now her freedom. This all started with a divorce, in which a victim of domestic violence asked for protection for herself and her children but instead was re-abused by the system that favored, and enabled the perpetrator, who continues to abuse through the legal system. 

Sandra, is well-loved and respected in the community, she does not deserve the harsh punishment meted out by Judge Asphaug and Dakota County. Sandra is not a criminal. She an abuse survivor who was pushed into making a heart-breaking decision after the court system and legal system failed to protect her children…the system continues to fail the Grazzini-Rucki family today.

Potential State Witness Wrote Letter to Judge Knutson – Criticizing Court’s Failure to Protect Rucki Children from Abuse

Lori Musolf, potential witness to be called by the State in the parental deprivation case against Sandra Grazzini-Rucki wrote a letter to Judge Knutson in May 2013, asserting her belief that the Rucki children were abused by their father, David Rucki, and were “terrified” of him. Lori criticizes Judge Knutson’s handling of the case and desperately prays “that the MN Appellant Court will put a stop to this insanity”.

With such strong beliefs, how did Lori become a potential witness for the State? And with such a drastic change in her story, does she have any credibility?

Lori describes herself as an “investigator”, “advocate” and “child advocate”. She also claims to have worked with Fox 9 news. Through the Carver County Corruption blog, she began to network with and offer her support to parents involved in family court proceedings. Lori explains in a Twitter post, “Sometimes people have to stand up to corrupt government.”

Lori’s main interest was in exposing perceived corruption in Meeker County. She worked with a group of citizens in these efforts and with the help of Trish van Pilsum from Fox 9, garnered publicity when van Pilsum covered two separate stories based on the Meeker citizen group’s efforts.

Lori’s letter to Judge Knutson was published on the Carver County Corruption blog in May 2013. Though the blog has been taken down, we were able to get a copy, with screenshots to validate its existence.

 

In the letter, Lori says about the Rucki girls “these young girls are obviously terrified of David Rucki. For these two teenagers to be on the run, obviously they are scared for their lives.”

 

Lori also criticizes Judge Knutson and says that he has made some “huge mistakes”. Lori writes to Judge Knutson “ I sincerely hope that you can look at ALL of the facts of this case, realize that you have made some huge mistakes, allowed other huge mistakes to be made and that you will  someday allow these children to live their lives in the home where they feel protected.

Lori also warns Judge Knutson, “In my opinion David Rucki is a loose cannon and you are playing right into his hands.”

After the Rucki girls ran away from the (temporary) custody of paternal aunt, Tammy Love, on April 19, 2013, they reached out to Lori for help (from the police report generated by Det. Dronen on 8/6/2015), Musolf told me that a day or two after S and G ran away from home, one of them had called her but she didn’t know which one. The girls told her that they wanted to tell their story to the media, and her to try to use her connections to get their story on the news. Musolf stated that the girls would not tell her were they were or give them a phone number to call them back but told her they would call her every half an hour or so to try and arrange an interview.”

 

The Rucki girls did call as promised, and each time they made contact Lori had an opportunity to call the police or notify the authorities on the whereabouts of these two missing children. She could have even made an anonymous report if she had any fear or concern. Lori consciously, and intentionally, chose NOT to make that call, as her phone rang every half hour, she spoke to the Rucki girls, and offered her support.

In May 2013, Lori arranged an interview between the Rucki girls and Trish van Pilsum of Fox 9, (police report),”She was present when the interview was conducted, and has asked the girls when it was over if they were safe, and they told her they were. She saw S and G walking to a fast food restaurant to get picked up when Musolf and van Pilsum left Sauk Center to interview Sandra Grazzini-Rucki.After the interview aired, Musolf assisted the girls by actively promoting their story, sharing web links and speaking out against what she viewed a “corrupt court system” that was responsible for their suffering. As time passed, Lori remained silent on what she knew about the missing girls, protecting them still.

According to the police report, on July 24, 2015 Brandon Stahl called Det. Dronen to inquire about updates on the case and discuss a tip that he had received. That tip led police to speak to a witness who then mentioned Lori Musolf by name, and made this statement, “..if Sandra knew where the girls were, Musolf would know as well.” The witness then provided Det. Dronen with Lori’s contact information. But before Det. Dronen could find Lori, Michael Brodkorb had already located her and spoken to her. This is clearly interference in an open police investigation.

Lori says in her August 6, 2015 police interview with Officer Dronen that she was once a strong supporter of Sandra Grazzini-Rucki until she started reading articles written in the Star Tribune, and began to doubt the abuse allegations she once defended, “She began to take notice of the case when Brandon Stahl and Michael Brodkorb’s articles began appearing in the Star Tribune.”

Lori’s doubts were reinforced when she spoke to Brodkorb, what information he shared with her is unknown, (from the police report) “She also stated that she had been contacted by Michael Brodkorb on 8/2/15. While she told me she didn’t tell Brodkorb anything, she stated that it really made her start digging into the case.” 

Lori must have known that her involvement with the Rucki girls could lead to criminal charges. From the police report, ”Musolf told me that she thought the friends (name omitted to protect their privacy) given Brodkorb her number, and she believed they were trying to pin things on her.” Friends gave Lori’s phone number to Brodkorb… keep in mind the lead that led police to these “friends” came from Brandon Stahl.

 

Has Lori made a deal at the expense of the Rucki girls?

Lori has never been criminally charged with her involvement in the case, though she clearly has aided and abetted two runaway teens. 

Edited versions of Musolf’s statement were included in criminal complaints against the Dahlens and were also included in the search warrant application for Dede Evavold. Lori may also be called as a witness to testify against Sandra. Did Lori make a deal to avoid charges?

Lori wrote to Judge Knutson, “David Rucki has a history of domestic abuse witnessed by these same children. How can you possibly think that putting these children’s lives in danger is ok?” Answer that Lori.

Given that the State’s case has largely relied on suppressing  evidence and witness testimony of abuse, stalking and violent behavior from David Rucki, if Lori is called to the witness stand, and this letter is introduced, it may be one of few allegations of abuse, and related documentation, brought to the jury.

That is, if court does not interfere with Lori’s vacation.

Dear Judge David L. Knutson,

 

As an advocate I am appalled at your court orders involving the Rucki case. I cannot fathom why you think teenagers have no choices in their lives, especially children who believe their lives are in danger. I hope you watched the Fox9 report on the Rucki case. I would like to point out a few things that I believe you may want to think about.

 

First, these young girls are obviously terrified of David Rucki. For these two teenagers to be on the run, obviously they are scared for their lives.

 

Did you notice how obvious it was that David Rucki knew exactly what conversation the girls talked about concerning the threats of him shooting them?

Quotes from the fox9 story “The Rucki girls told FOX 9 their father sat them down at the kitchen table and threatened to shoot them and their mother.” David states, “What I think I said is, ‘What do you want me to do? Put a bullet in my head so you don’t have to deal with this?’”

Think? He obviously was in a rage during this conversation.

 

David Rucki has a history of domestic abuse witnessed by these same children. How can you possibly think that putting these children’s lives in danger is ok? What could you possibly be thinking?

 

David Rucki said the Rucki case file is the biggest in Dakota County Family Court. Is he proud of this? Why would he even elaborate on that if he didn’t take some pride in it? Former owner of Rucki trucking? I hope his employees found this amusing and come forward.

 

Second, David Rucki’s attorney Ms. Elliot claims, and I quote from the Fox9 story, “He probably did have a short temper. There were five kids. Things get crazy. Did he ever harm them? No,” said Elliot. “Maybe he didn’t try hard enough to stay in contact with them when this was going on thinking if things would calm down, it would go back to the way it was — but it went in the other direction.” He probably did have a short temper. Obviously he did if he is talking about shooting himself in the head. “There were five kids. Things get crazy.” Wow, really? I have five children and four grandchildren and nothing in my home has been crazy enough to allow me to be violent or threaten my children. Ms. Elliot also stated, “Did he ever harm them… No” How could Ms. Elliot possibly know this? Was she there? Unbelievable that someone in the field of law could make such ridiculous statements as if they were facts. I believe Ms. Elliot has done this repeatedly throughout this case. Such a sad case when a judge allows someone like Ms. Elliot to conduct herself in this manner. Is Ms. Elliot the person running the show making you look like a fool?

 

Ms. Elliot goes on to state, “”They tried three different therapists or professionals in the Twin Cities to try reunification while the children were still living with their mom and it just didn’t work,” Do you really think that reunification with a threatening abusive person should work? These children are terrified of this man and they know that neither you or the therapists on this case will listen and have sentenced them to a life of pure hell and danger. This is absolutely appalling. How can you sentence these children to this life?

 

Third, Mr. Reitman reeks bias in this case. How can he even consider the fact that only the mother has created parental alienation? Have you heard the audio’s of David Rucki’s messages to his children blaming their mom for everything? What is even more appalling is the fact that what I would refer to as a “hired gun”, Mr. Reitman, believes that children should be forced to visit with a father, even if sexual abuse is an issue, because of lack of evidence. Are children supposed to say, “Hold on dad, I have to get the video camera to record this as evidence?” I can only hope the sexual abuse advocates go after any license this monster holds. I would say this story exposed Mr. Reitman for what he is……a monster!

 

Last but not least…. Shame on you for allowing this family to be torn apart by your orders. Shame on you for forcing children into a relationship with a father they are terrified of. Shame on you for forcing these children to make the drastic decision to go on the run in order to protect themselves. Shame on David Rucki for threatening these children and helping to destroy their lives with his continuing insane actions. Shame on Ms. Elliot for allowing any of this and defending this father. Shame on Dr Reitman for his sadistic beliefs. Shame on our judicial system for not making all of you accountable for your actions.

 

In cases like this I have to wonder how our system got to the point that destroying families in today’s society is ok. I think of all of the children that have been murdered by their parents in disputes and I have to wonder how you could put those children in this position. How will you feel if the next time David Rucki loses control, one of these children are severely injured or worse yet dead. In my opinion David Rucki is a loose cannon and you are playing right into his hands.

 

I sincerely hope that you can look at ALL of the facts of this case, realize that you have made some huge mistakes, allowed other huge mistakes to be made and that you will  someday allow these children to live their lives in the home where they feel protected. How can you possibly think that putting children in danger is the thing to do? I can’t even begin to wrap my head around your reasoning. I can only pray that the MN Appellant Court puts a stop to this insanity.
