Does a P.I. Report Confirm Abuse in Grazzini-Rucki Case?

Michael Volpe released a report from an investigator working for Grazzini-Rucki co-defendants Doug and Gina Dahlen during their criminal case. Investigative Affidavit in the Rucki Case

 “Here is an affidavit submitted by a private investigator which confirmed that Samantha and Gianna Rucki were indeed abused by their father, David Rucki…”

The Dahlens allowed the Rucki sisters to live on their therapeutic horse ranch after they ran away when family court judge David L. Knutson placed them in the custody of a paternal aunt then planned to reunify, and give custody, to the abusive father they feared.

The girls remained with the Dahlens for nearly two years before being recovered in November 2015. The Dahlens say the girls stayed of their own free will choice and resisted opportunities to return to their father’s care.

Police records show that after being found living on the ranch both girls continued to state their father had abused them and they would run away again if returned to his care. According to the Lakeville Police Department report: “On 11/19/15, Detective Coughlin and I met with Dakota County Social Services and David Rucki. Arrangements were made for the girls to be placed into foster care, as they continued to express that they would run away again if they were brought home.

Father, David Rucki, denies any abuse occurred and sought reunification therapy for his daughters.

The Dahlens were criminally charged with felony deprivation of parental rights and avoided trial by agreeing to a guilty plea.

I’m not into exposing anyone or the “gotcha” stuff…” ~ Michael Brodkorb

Blogger, Dede Evavold, of “Red Herring Alert” recently published an article Inverting Reality (Red Herring Alert) exposing blogger Michael Brodkorb’s coverage of the Grazzini-Rucki case as propaganda, and citing specific incidents where he engaged in harassment and defamation against her, under the guise of “journalism”.

Inverting Reality” also discusses Brodkorb’s troubled past , documenting a long history of out of control behavior – a domestic violence incident involving his wife, a sexual fling with Senate Majority Leader Amy Koch that ended his political career, and driving while intoxicated, crashed his car and nearly killed himself. In another embarrassment, in 2011, Brodkorb made secret recordings of conversations with his GOP bosses regarding his firing (after his tryst with Amy Koch was exposed) . The recordings revealed, among other things, that Brodkorb was struggling with his mental health – which could explain his erratic behavior. 

Brodkorb also has a reputation for inciting fights within ranks of the Republican party, among his own team , where he was known for screaming fits and personal attacks against others, it said his eruptions could leave fear in his wake..(The Fall of Michael Brodkorb) Another Republican, retired Army Lt. Joe Repya, described Brodkorb as “a ‘thug’ with ‘an intimidating personality’ who ran roughshod over party members, elected officials and even volunteers…’You have to understand how frightened people within the party became of Michael Brodkorb..’ (Michael Brodkorb: Admired, feared and, above all, Republican )

Brodkorb has also been described as “always pushing the limits..” Brodkorb, once one of the most powerful people in the Senate, used his political knowledge and connections as ammo in carefully crafted blogs designed to attack political targets. Democrats denounced Brodkorb as a “Republican operative” paid to write hit pieces on their candidatesFor his work, Brodkorb was paid very well. Initially Brodkorb began blogging anonymously on Minnesota Democrats Exposed (created in 2004) but in a fit of rage, he accidentally exposed his identity while posting online, and reluctantly, was forced to admit to his clandestine activities. Brodkorb says about MDE,”When you’re writing Minnesota Democrats Exposed you’re waking up every day and looking for a target. Even though that kind of thing drives traffic, it’s not a very fulfilling way to write...” (‘I’m done with partisan politics’: a Q&A with Michael Brodkorb) Due to the insulting content of MDE, Brodkorb was sued for libel – dismissed by a court in 2007. Complaints continued to be raised against Brodkorb to this day. 

 In the end it seems both the Democrats and the Republican got the last laugh – as Brodkorb’s antics resulted in his political career going up in flames.

Setting politics aside, what is really at issue here is Brodkorb’s character, and pattern of bullying that continues to this day, now manifesting in rage towards Sandra Grazzini-Rucki, co-defendant Dede Evavold, and supporters. The venom to which Brodkorb spews on social media rants, and articles, has led many believe that he works on David Rucki’s payroll.

Indeed, all of Brodkorb’s articles on the Grazzini-Rucki case portray Rucki in a sympathetic light and have ignored or minimized Rucki’s lengthy criminal history, as well as the extensive evidence of the abuse Sandra and the children suffered at Rucki’s brutal hands. There is only one side that Brodkorb portrays – and that is of David Rucki.

Let’s take a deeper look…

Brodkorb: “It Was All About Search and Destroy…

History is known to repeat itself, and only history can be trusted to tell the truth about Michael Brodkorb.

In 2004, Brodkorb begins blogging on Minnesota Democrats Exposed. Tactics used on MDE are eerily similar to those used by Brodkorb today, in his coverage of the Grazzini-Rucki case, “ When I was writing Minnesota Democrats Exposed, it was all about search and destroy, writing sensational headlines, driving traffic and making mountains out of molehills. It was something I got out of my system… (‘I’m done with partisan politics’: a Q&A with Michael Brodkorb)

Brodkorb’s search and destroy tactics paid off, he became indispensable to political candidates seeking to dig up dirt on opponents, and dedicated his blog to mud slinging. For his work, Brodkorb was paid generously. In November 2006, Brodkorb was the highest paid blogger in the state of Minnesota, generating $55,200 a year to work for the campaign of Rep. Mark Kennedy under the guise of “part time press consultant”. Brodkorb achieved this feat by a narrow margin – Sen. Brodkorb strongly denied that he has ever been paid to blog, but that has proven to be just another one of his many lies. (Bloggers proliferate on campaign rolls)

A blog (from February 2006) documents Brodkorb’s long history working as a paid operative, “Over the past two years, John Kline’s campaign paid $10,000 to Weber Johnson PA, a political consulting firm run by the brother of former Republican Congressman Vin Weber. Oddly enough, the source of many anonymous attacks on Kline’s opponent Coleen Rowley have come from a blogger who is employed by Weber Johnson PA…”  (Kline’s $ To Company That Pays Anonymous Blogger’s Salary? ) WHO led these anonymous attacks? None other than Michael Brodkorb.

Another example, from an expose written in Feb 2012( Brodkorb paid from GOP Senate Victory Fund) reveals that “the Republican Senate Victory Fund paid Michael Brodkorb $7,500 for consulting work on January 31, 2011, as documented in a just-filed campaign finance report. This was in addition to $20,625 in late 2009, and $16,875 paid to Brodkorb for research in 2010. In sum, Brodkorb was paid $45,000 in in sixteen months from the Senate Victory Fund. These payments were in addition to Brodkorb’s state employee salary as a Senate staffer…Brodkorb earned about $90,000 a year in his job as communications chief for Republicans at the Capitol.

Michael Brodkorb made a name for himself, and a career, by playing dirty. Pay Brodkorb enough, he will say anything. He rewrites facts and distorts information. He resorts to personal attacks and defamation without remorse. Brodkorb is not an independent source – he is a check book journalist who cannot be trusted.

An Experiment Gone Horribly Wrong

During the period Brodkorb covered the Grazzini-Rucki case for the Tribune, he was contracted as “just experiment. Terry Sauer, the Tribune’s assistant managing editor for digital, gave a temporary offer to Brodkorb to write political editorials to balance the Liberal editorials published by the paper. The Tribune did not contract Brodkorb to write about the Grazzini-Rucki case; Brandon Stahl had already begun to to cover the case, and at the time was a popular reporter in Minnesota. Brodkorb’s assignment with the Tribune quickly turned into an obsession with Sandra Grazzini-Rucki that spun out of control when he became the mouthpiece for David Rucki, and began to suppress critical facts and evidence in the case to cover up the abuse of Sandra and the children, as well as the illegal activities of the court.

Brodkorb admits that he was attracted to David Rucki from their first meeting in April 2015 (Why I Wrote About the Rucki Case )Meeting David Rucki was one of my most emotional moments in writing about the case…. Physically, David is a big man – tall and broad. But his face looked lost and sullen. You could see the pain and sadness as he spoke about his missing daughters.

At one point, I was so overcome I had to excuse myself from our table at a restaurant in Minneapolis. I went to the restroom, splashed cold water on my face and took a moment to compose myself.”

An amber alert was never issued for the missing Rucki teens, and the police had stopped searching for them; presuming, correctly, that they were runaways. In their absence, David Rucki was given custody of all five children; at the time of the custody order he was on probation for violating a protective order against ex-wife Sandra. Rucki had also been ordered into anger management numerous times, which did nothing to quell his rage. Judge David Knutson, family court judge, ignored abuse allegations raised by the Rucki children and the evidence supporting their cries for help. The courts should have protected the Rucki children but, instead, sent them into the custody of a dangerous abuser, whom they have not been able to escape from. You will never hear about any of these facts in Brodkorb’s reporting.

For what Brodkorb had previously been paid, the Tribune wasn’t offering much. Sauer says he paid Brodkorb a modest salary – just “hundreds a month” – apparently he wasn’t worth even that! Brodkorb’s political articles failed to gain public interest; and his involvement in the Grazzini-Rucki case became the subject of controversy. The Tribune had enough of this “experiment” and in May 2016, ended their contract with Brodkorb. Sauer said about cutting ties with Brodkorb, “It really is all about us moving in another direction with the budget we’ve got.” (Brodkorb on the end of his Star Tribune blog: ‘It was never meant to be a forever thing’)

Apologetically Sauer offers to give Brodkorb a job reference.. is that sincere or just lip service? How many times do girls break up with their boyfriends and offer to “just be friends”. Same thing.

A Village Missing It’s Idiot in Minnesota

For the past several years, Brodkorb has spent long days and nights in front of a blinking screen, obsessively covering the Grazzini-Rucki case, while life goes on around him.

Blogger Dede Evavold, of Red Herring Alert, a victim, reflects, “Brodkorb became a pen for hire to harass and intimidate witnesses, interfere with the legal process and lie with impunity during our trials.

Michael Brodkorb currently has a blog that is now entirely dedicated to demonizing and discrediting me to change the narrative in this case and shift the focus away from the true facts.

He also added Allison Mann as a contributing author. Who is Allison Mann? Mann is a paralegal with Elliott Law Office and lives in Lakeville, Minnesota. Elliott Law Offices provides legal services to the father involved in this case, but Brodkorb states. ‘Elliott Law Office is not affiliated with Missing in Minnesota.’ Okay, and I’ve got prime swampland to sell you! Also, Allison Mann has been the photographer of the numerous photos taken prior to my false court hearings on my false charges…” Inverting Reality (Red Herring Alert)

Has Brodkorb been paid for his coverage of the Grazzini-Rucki case, and online attacks against Sandra Grazzini-Rucki and supporters?

Let’s Take a Look at Brodkorb’s Record:

*History of working as a blogger paid to write propaganda, and generate attacks against targets. Lies about receiving payments for writing blogs.

*Strong interest in Judge David L. Knutson, family law judge assigned to Grazzini-Rucki case. Previous connection to Knutson while working in the Senate.

*Has an emotional breakdown after meeting David Rucki, flees to the bathroom to splash cold water on himself in order to compose himself.

*Contracted to write political commentary for the Star Tribune then radically shifts focus to cover Grazzini-Rucki case, at a time that case was already being covered by a well-known reporter.

* Admitted has no prior interest in investigating missing children when becomes focused on Grazzini-Rucki case.

*Interfering in active police investigation while covering Grazzini-Rucki case for Star Tribune. One example – speaking to a witness, who was sought for questioning by police, and influencing her testimony before the police were able to talk with her.

*Attaches himself exclusively to David Rucki at all court hearings.

*Coverage of Grazzini-Rucki case is one sided, always supportive of David Rucki. Suppresses documentation and evidence that is contrary to the narrative he pushes.

*Lying, exaggerating or distorting information about Sandra Grazzini-Rucki, Dede Evavold, and supporters.

*Exclusively focuses on Grazzini-Rucki case and no other case involving family court issues.

*Devoted a blog to coverage of Grazzini-Rucki case in a similar fashion to previous blogs he created to attack political opponents. The public is not given all the facts or evidence available in the case.

*Brodkorb’s blog is the only blog that has not been threatened with legal action by David Rucki to stop reporting on the Grazzini-Rucki case.

*Brodkorb’s blog is the only blog that has not been criticized or threatened with legal action by Judge Karen Asphaug, and Dakota County, for its coverage of the Grazzini-Rucki case.

*The Carver County Corruption blog was shut down after Rucki and his high buck attorney, Marshall Tanick, threatened legal action against the blog owner. When clicking on old links to Carver County Corruption, the site opens to Brodkorb’s blog devoted to the Grazzini-Rucki case.

(Dakota County, Minn) This article draws upon court records and legal research that suggests David Rucki has received special treatment in cases presided over by both Judge David L. Knutson  and Judge Karen Asphaug. From Volpe: “The judges in Sandra Grazzini-Rucki’s criminal and family court case may have previously fixed cases for her ex-husband, raising further doubts about the fairness of their rulings.

In one incident, Judge Karen Asphaug presided over a criminal charge of disorderly conduct against David Rucki.

The charge resulted after an incident on September 8, 2009, where Rucki was arrested after becoming aggressive and threatening towards his neighbors. According to the complaint,”He stated the suspect (Rucki) threatened his wife, his son, then called them all assholes…

A juvenile victim reported that Rucki called her mother “a crazy lady” and “a stupid bitch“. And said Rucki threatened,”If any of you assholes ever call the police on me again, I’ll raise holy hell.”

Another juvenile victim reported that Rucki threatened him and swore at him, call him a “little son of a bitch“.

According to witness statements, Rucki’s behavior was escalating to a frightening level. David Rucki thinks “asshole” is an appropriate term for a three year old.

The same neighbor filed for a harassment order  after this incident HRO Filed Against Rucki 2009 and then installed security cameras around his home.

This image below was taken from additional security cameras that ex-wife Sandra Grazzini-Rucki had installed around her home, capturing on numerous occasions where Rucki was stalking and harassing Sandra and children. Even after a protect order was filed, Rucki would not stay away…. or abide by the law.

The police report also suggests that Rucki knew that he he could avoid criminal charges in court.  Rucki’s behavior indicates that he really does think that he is above the law – above any consequences. All of this is happening before Rucki ever sets foot in court.

Back to the police report:

Officer Michelle Roberts writes in her report,”Suspect (Rucki) told me that he didn’t have to listen to me. I advised him that if he would not allow me to question him regarding the specifics, I would have no choice but to charge him with disorderly conduct based on their allegations.

He stated,’Go ahead, it’s their word against mine and you can’t prove anything.’

I told him I would mail him a citation for disorderly conduct and he would have the opportunity to give his side in court. He responded,’I’m not going to show up for court, this is bullshit.’  He then said,’You guys can get the fuck off my property.’ Suspect approached us two additional times, each time arguing that we couldn’t take their word over his.

In a supplemental report written by Officer Barb Maxwell, she took a complaint from the neighbor regarding Rucki’s frightening behavior towards his family. Officer Maxwell notes that when she attempted to speak to Rucki, he “..tried to intimidate me. I introduced myself and stated,’I am here because of a complaint on your dogs.’ Rucki got very close to me and said,’There is NO complaint on my dogs‘, and from that point on I was unable to say another word.” Rucki then went on to refer to the neighbor as a “bitch” when speaking to the police.

Where is Rucki’s attitude coming from? Is this the typical mentality of an abuser or is there something more.. is someone protecting Rucki from within Dakota County,  the legal system?

 The disorderly conduct case came before Judge Karen Asphaug, on 12/31/2009 when a preliminary hearing was held. A trial date was then set. But before the case could go to trial, the defense filed a motion to dismiss for “lack of probable cause.” That motion was granted without a hearing by Judge Asphaug and the case was abruptly thrown out.

 

How could there be “lack of probable cause” when witnesses to the crime included police officers? When there would be physical evidence such as dog feces and paw prints in the neighbor’s yard? When there were multiple witnesses? When an HRO was granted? When Rucki was making comments to police that implicated himself in the crime?

 That Judge Asphaug presided over this prior disorderly conduct case  against Rucki should have disqualified her from later presiding over the criminal case of Sandra Grazzini-Rucki. That Judge Asphaug had knowledge of an incident involving a criminal charge against Rucki, where he was accused of violent behavior, creates a conflict of interest.
Further, this incident with the neighbor should have been allowed as evidence at Sandra’s criminal trial. The neighbor had also written letter to describe his experiences with Rucki,”In our near decade of living next to him I have found him to be a very angry individual rages at anyone who has contention or confronts him. It got so severe against our family that the court awarded us a restraining order in September 2009….
As police reports can verify, he has boldly cursed profanely at, and tried to intimidate Lakeville’s female animal control officer. It is logical to conclude he is capable  of more towards those more vulnerable, such as his wife and children.victimletter
Instead, Judge Asphaug suppressed this evidence from the jury in the criminal trial of Sandra, forcing the jurors to find her guilty of parental deprivation because without evidence, the defense was not allowed to effectively argue it’s affirmative defense. Judge Asphaug also concealed her prior involvement with Rucki, and that she dismissed the disorderly conduct charges under unusual circumstances.
Judge Asphaug suppressed other evidence in the criminal trial of Grazzini-Rucki, including (Volpe):Although Rucki had appeared before this judge charged with violating a restraining order, however, the jury was never informed of this. That’s because the judge disallowed any mention that anyone ever took out a restraining order against Rucki when, in fact, four separate restraining orders were successfully taken out against Rucki. Ironically, Judge Asphaug also disallowed any mention of Rucki’s long criminal record as well as letters written by the children involved.

If that were not outrageous enough, Judge Asphaug refers to David Rucki again and again in the criminal trial as the victim, and in heavily sympathetic terms.
Victim? David Rucki is clearly a man who has demonstrated a propensity towards violence. He violates protective orders. He threatens his family and neighbors. And has tried to intimidate police… and more… David Rucki is NOT a victim. He is a dangerous predator.

Police Report, HRO: David Rucki is Dangerous, Not Safe Around Children

In 2011, Judge David L. Knutson ordered the five Rucki children into reunification therapy and supervised visits with father, David Rucki, while two separate harassment orders were in place against him (one harassment order filed by Sandra, the other filed by a neighbor).

The danger Rucki poses to children is noted in a police report filed against Rucki prior to obtaining the HRO which states,”he and his wife run a daycare at their home and are very concerned for the children they care for (due to Rucki’s threats and aggressive behavior).

Along with the HRO, Rucki has a long history of violent behavior that manifests in both his criminal record, and in the abuse allegations raised by ex-wife Sandra Grazzini-Rucki and children. druckipolicereports (See page 11-21 for information related to this article) Court documents also indicate that Rucki was ordered in anger management classes on 3 separate occasions, and during the divorce was ordered into domestic abuse counseling.

Despite overwhelming evidence, Judge David L. Knutson refused to acknowledge the abuse, and has put the lives of the Rucki children at risk by first by court-ordering the “de-programming” the children to recant abuse allegations and then by giving sole custody to Rucki – after proven to be dangerous, emotionally unstable, and not safe around children.

NOTE: This article contains some of the defense evidence suppressed by Judge Karen Asphaug during the rigged trial of Sandra Grazzini-Rucki.

The harassment order was filed by a neighbor R.M. (issued on September 15, 2009) and barred Rucki from having any contact with his wife R.R.M., their two children and even the children enrolled in the daycare they operated. HRO Filed Against Rucki 2009

According to the HRO David Rucki terrorized the family in the following ways:

Made Threats:He said he would unleash holy hell if we ever turned him in again”. “He also did a threat later in the street. He’s mad we called animal control over his dogs.”

Exhibited Frightening Behavior: Loud, Cursing, Coming in Close proximity to their house and mailbox.

Called the Victim(s) Abusive Names: Called my wife a “bitch” and my son a “son of a bitch” and called us “assholes”. Cursing at us while daycare kids present.

While the HRO was in place, Rucki violated the order numerous times. The neighbors were so frightened that they placed security cameras around their home.

The HRO remained in place for 2 years – the reason the neighbors did not renew the HRO was because Sandra had a protective order in place that prohibited David from coming near the cul-de-sac, where the neighbors also lived, so they felt that restraining order would also protect their family. This proved to be false – Rucki has stalked Sandra, and violated protective orders she filed against him. Sandra’s protective order was later dismissed by Judge David L. Knutson.

Journalist Michael Volpe, covering the Grazzini-Rucki case, just released a police report filed by R.M on September 8, 2009 . The police report documents the terrifying incident that led up to the HRO: David Rucki thinks “asshole” is an appropriate term for a three year old.

The police report demonstrates abusive behavior, and an abusive mentality through Rucki’s own words and actions. A pattern also emerges from the police report that corroborates abuse allegations raised by Sandra.

Domestic violence is defined by a pattern of abusive behavior that is used to gain power and control over another person through threat, force, violence or intimidation. Domestic Violence – US DOJ

What is particularly dangerous about Rucki is that he attempts to exert power and control over anyone close to him -beyond his family. Rucki literally prowls the neighborhood, and by extension Lakeville, as his own territory much like an alpha wolf.

A Few Examples of David Rucki’s Pattern of Abuse:

The police report describes Rucki threatening and swearing at the neighbor’s children and also swearing at the children in the daycare.

Rucki threatened and swore at the neighbor’s wife, R.R.M.; including incidents where children were present. Rucki is so brazen that he referred to R.R.M. as a “bitch” while police were present!

The threats and profanity are the same as what Rucki has said to Sandra, and his own children. The viciousness of Rucki’s words were captured in a series of voice mail messages left for his teenage son (Comments taken from picture above. Also read transcripts recorded voice mail messages)

Rucki refers to R.R.M. as a “crazy lady“. Rucki also accuses ex-wife Sandra as “crazy”. Sandra has never been diagnosed with mental illness. Rucki continues to avoid questions about his own mental health, and the results of his psych evals.

Rucki admits in the police report that he called Child Protective Services on the neighborsdue to safety concerns for the children“. Reading the police report it is obvious the only safety concern that exists is David Rucki. It is clear Rucki made a false report to CPS because he was angry at the neighbors, and was carrying out on threats he made against them.

Rucki made false reports against Sandra to the family court professionals and during the criminal trial, claiming she is a danger to the children. There have never been any findings of abuse against Sandra. Just the opposite – when court proceedings began, the Rucki children  expressed they shared a loving relationship with their mother and wanted to live with her. It is only through forcible separation, and under the threat of de-programming that has Sandra become estranged from her children.The allegations Rucki raised against Sandra are not motivated by genuine concern but rather, are a form of abuse.

Another example – while the police officer was interviewing R.M. (quote),”he informed me that suspect (Rucki) drove by as we were speaking and put up the middle finger of his left hand at him…” Rucki later admits to police that he did make a gesture but says, “I only waved at them, they can see it however they want.

Finally, when the police interview Rucki he is angry and refusing to cooperate. The officer informs Rucki that they will have to charge him with disorderly conduct, Rucki replies, “Go ahead it’s their word against mine and you can’t prove anything.” Rucki approached police two additional times stating “that we couldn’t take their word over his“. Rucki attempts to intimidate police to get them to drop charges against him.

In another section, Rucki basically says the laws do not apply to him. He attempts to intimidate another police officer into dropping a complaint against him.

This is similar behavior as what was reported by S.R. (one of the teens who ran away due to Rucki’s abuse) – that she was pressured and guilted into recanting abuse allegations by Rucki: Pressured, Threatened S. Rucki Bravely Speaks Out Against “Horrendous” Family Court

You can’t prove anything” could also explain what has happened to Sandra throughout all of the legal proceedings from 2011 to the present – Dakota County, has taken the word of David Rucki as fact and completely violated the law, and dismissed significant evidence and documentation in doing so.

To better understand the devastating effects of the abuse David Rucki inflicted on his children, this article will share a police report from June 24, 2011 from a first person perspective. The “perspective” is based on the actual police report as well as other publicly available documents that disclose abuse, and record allegations of abuse made by the Rucki children in their own words.

75% of defense evidence was withheld during the Grazzini-Rucki criminal trial. The jury was never allowed to consider evidence raised by the Defense, supporting the affirmative defense: It is an affirmative defense if a person charged under subdivision 1 proves that:

Without evidence to support a “reasonable belief”, and given instructions from Judge Asphaug that were both misleading, and manipulative, the jury found Sandra Grazzini-Rucki guilty on 6 counts of deprivation of parental rights. If the jury knew of this incident, and made aware of other evidence, would the outcome have been different? And would the outcome had been different had the jury know that Judge Asphaug presided over a previous domestic violence complaint against Rucki, and dismissed it?

Happy Birthday! S.R. walked down the cul-de-sac at Ireland Way with a group of giggling, excited teenage girls looking forward to a slumber party, and a night of fun. The house was decorated with banners and balloons, gifts were beautifully wrapped for her special day. The deep rumble of a motor followed by a harsh voice yelling her name tore through the warm summer day like a thunderbolt. She turned her head to see her father pulling up alongside the girls, yelling and swearing at her.

Her heartbeat hammered in her chest so fast she feared it would take off, seeking escape from her father’s anger. Since the divorce, things were so much calmer at home, she actually enjoyed being there… without having to deal with his rage, his flying fists, the ugly words he screamed at them…he hurt her mother and made her cry. But he didn’t stay away. After the divorce, in May, he tore through the house, and refused to leave when asked. He was yelling and screaming, threatening, ripping pictures off the wall. He drove up and down the street all hours of the day at night. He watched the house. He left angry voice mail messages. Just a few days ago, he was at the house again, stealing mail from the mailbox.

Ignoring him didn’t help. She told her father that she did not want to see him. He would not listen. You couldn’t pretend that everything was fine when it felt like your heart was breaking into a million pieces. When you were trying to hide the secret that made you so different from your friends. When you couldn’t hold up the fake smile anymore because the tears kept falling. Ignoring him just made him madder – and now he was here, on her birthday, without a present or a card, instead yelling – swearing – scaring her friends – ruining everything.

Giggles gave way to shrill, girlish screams. The word “run!” was a collective cry, one voice could not be distinguished from another. Run but where? The cul-de-sac had one way in and one way out. Only one way.

She remembered dressing up for her party, pulling her hair back in a pony, wondering if Mom would let her wear make up… now her feet slapped against the pavement, mud staining her sneakers. Her hair tore loose, and tangled at her shoulders. The girls grabbed at each other as they ran, tumbling into the nearest house. Her pretty outfit was ruined. Her friends were scared. And everyone was looking at her like they knew, all along, the ugly secret she tried to keep. As if windows could shut in the the threats, the yelling, the crashing sounds coming from the “Scream House” night after night. Her friends knew, and they were terrified. The door rattled as her father came up to the house, slamming the screen door open and pounding his fists on the door. He shook the door handle, trying to pry it open. Someone called the police. Someone hid. Someone called Mom. She ran into the pantry, sobbing. It was all happening so fast.

She wanted Mom to hug her and tell her everything would be okay. But she knew that wasn’t true. Lakeville Police had arrived, they looked over the court order that was supposed to protect them from her father… and said it did not cover her, a child. The judge had crossed the names of the children out on the OFP application. Mom said the order for protection meant that Dad could not be so close to the house, he was in violation. She wanted to press charges but the police officer told her to go back to court, he couldn’t do anything. No charges would be filed. And the officer certainly could not fix her birthday party – and now her friend’s parents now said they didn’t feel it was a good idea to have a slumber party. The parents didn’t feel safe that their children were at her house, the “Scream House”. Mom begged until they agreed to come over for cake. All she saw when the candles were lit was the flashing blue and red of police lights. By then the cake had melted, the pink frosting felt too sticky and choked in her throat.

One of the victims involved in this incident declined to file a police report, stating they are afraid David Rucki will retaliate against them.

Sandra Grazzini-Rucki’s application for an Order for Protection for her 5 minor children was denied on June 30, 2011. David Rucki continued to violate the OFP, and continued to harass, intimidate and stalk his family.

David Rucki violated the Order for Protection granted to Sandra Grazzini-Rucki on June 22, 2011 on two separate  instances, and plead guilty to one incident on September 19, 2011.

Family court Judge David L. Knutson awarded David Rucki sole custody of the 5 children despite overwhelming evidence of his abusive, and violent behavior. The children’s fear of Rucki is directly related to his behavior towards them. When awarded custody, Rucki was probation for a charge that resulted after he violated an OFP. Judge Knutson has actively worked to cover up the abuse allegations in the Grazzini-Rucki case, and has even dismissed criminal charges against Rucki.

Sandra continued to petition the Court for help, and raised abuse allegations in the custody trial – at every level, those who had the power to protect the Rucki children failed, and enabled the abuse to continue.

Rucki Child Speaks Out – Social Media Post Offers Glimpse From Months Leading Up to Disappearance of Sisters

Dakota County, Minn: A shocking piece of evidence suppressed by Judge Karen Asphaug during the criminal trial of Sandra Grazzini-Rucki is being publicly posted – see for yourself what the jury was not allowed to consider.

Judge Karen Asphaug suppressed 75% of defense evidence in the Grazzini-Rucki criminal trial and refused to allow several witnesses to testify, including a witness to David Rucki’s violent behavior and another witness who is an expert on domestic violence. Grazzini-Rucki raised the affirmative defense, meaning her involvement in the disappearance of her two teenage daughters resulted not from criminal intent but because she had a reasonable belief that the present environment posed imminent harm to her children. Grazzini-Rucki’s defense depended on showing the reasons why she feared for the safety of her children – which was contained in the exhibits jurors were not allowed to see.

Under these unjust circumstances, Grazzini-Rucki was convicted on 6 counts of felony deprivation of parental rights after the defense was limited in what it could present to the jury, and otherwise constrained. Grazzini-Rucki has appealed the conviction. 

There will be no appeal for the five Rucki children – who have been sentenced to live with their abusive father, David Rucki (who was on probation for a violation of a protective order when granted custody). The Rucki children have raised allegations of abuse, and asked to live with their mother only to be ignored by the family court, Guardian ad Litem and professionals, charged with protecting them. The evidence is overwhelming that Dakota County has conspired to take custody from a fit, loving parent and place these children in an abusive, dysfunctional environment.

A social media post, of what appears to be a diary, written by one of the Rucki children, and posted on May 13, 2013, offers a glimpse into the thoughts and feelings of a child living in an unimaginable nightmare.

This child attempted to run away, along with 4 siblings after Judge David L. Knutson forced Grazzini-Rucki out of her home on September 7, 2012, and temporarily transferred custody to paternal aunt, Tammy Jo Love (who never filed a motion for custody). Incredibly, all 4 children attempted to run away upon hearing the news – and the older children were not in the same location as the younger ones, meaning there was no planning, but rather a reaction based on fear alone.

The child was later found wandering down a busy street, more than 2 miles away from home, crying for mother. The child told police that Love had been abusive, and that if returned to her care, would run away again. Though a mandated reporter, the police never filed a report with CPS. Due to safety concerns, temporary custody of the Rucki children was instead transferred to a maternal aunt.

Seven months later, Judge Knutson again attempted to transfer the Rucki children into Love’s care. The only reason the two younger Rucki children did not succeed in running away was because they were detained at school, and physically prevented. The older two sisters, S.R. and G.R. did succeed in running away, and remained in hiding for 2 years; although the sisters had every opportunity to go home they chose not to, believing they would not be safe in the care of Love, or their father, David Rucki.

The  author of this social media post describes their feelings in the months before – and after – older sisters S.R. and G.R. ran away on April 19, 2013. The diary was written on what appears to be a dry erase board and includes one word statements with a date to indicate when they were written. Many of the statements include what you would expect from a pre-teen, but there are also troubling statements that show signs of fear, and indicate a problem. The words: “Scared”, “Killed” “Miserable”, “Creeped” and “Escaping” are included along with drawings, that include faces with wide eyes and gaping mouths.

The importance of this diary is that it is the only publicly available record that offers a first-hand account from one of the Rucki children – in their own words, without being altered or manipulated. Each entry is dated, which provides a picture of the mental and emotional state of this child in the crucial months involving court hearings (the children were present in court at some of the hearings the request of Dr. Gilbertson, and also spoke with judge David L. Knutson) that ultimately lead up to a transfer of custody, and then sisters S.R. and G.R. running away on April 19, 2013 in fear for their lives.

In an interview with Yahya McClain (12/28/16), Sandra Grazzini-Rucki said her children wanted to speak to the court, and wanted to be heard, but the court would not allow them to provide input, and instead worked to silence them. In fact, Judge David L. Knutson spoke to the Rucki children in chambers on Feb 26th 2013, and sealed the transcript after the children spoke about abuse; thereby blocking the abuse allegations from being entered into the record. An entry from the former Carver County Corruption blog have preserved what S.R. and G.R. wanted to tell Judge Knutson, Dr. Gilbertson and GAL Julie Friedrich, their personal note along with a cover letter were sent to 150 Representatives and Senators in Minnesota shortly before S.R. and G.R. ran away (below). The highest levels of government in Minnesota have been made aware of the egregious abuses of power and violations of law happening in the Grazzini-Rucki case.. and so far have not responded. How many more families need to be victimized, and how many children more need to be abused before the State of Minnesota will do something to hold out of control judges, and related family court professionals, accountable?

Another way the Rucki children have been silenced, and their testimony altered, is by unethical treatment from court-appointed therapist Dr. James Gilbertson, who conducted“reunification therapy” on the Rucki children. Some of the sessions with Dr. Gilbertson included forcing the Rucki children to attend court hearings where they were forced to listen to painful details of the family’s troubles. Judge Knutson and Dr. Gilbertson used mother, Sandra Grazzini-Rucki, as an example to demonstrate his power over their lives and send an intimidating message to the children. Grazzini-Rucki was the primary caregiver, and shared a close loving relationship with her children. There were times she shielded her children from Rucki’s rage by putting her body in front of his fists. Imagine then, the horror the Rucki children must have felt watching their mother, their protector being humiliated and re-abused in the family court; laws easily broken with just the wave of a gavel.

On February 6, 2013, Dr. Gilbertson wrote a letter to Guardian ad Litem Julie Friedrich (link below) that the court needed to take an “assertive stance” with the children and stated,The presence of the court, a bailiff nearby, my own presence, and then meeting with father, in my opinion, would deal with the fears they experience, either real or imagined.”

And,”I understand this may represent a somewhat unorthodox recommendation, but I do not believe there could be a bridging of the gap between the children and their father, at this point in time, unless all are physically present under the authoritative and safe umbrella of the court.”

These are children we are talking about – frightened, vulnerable children who are being treated by Judge Knutson, and the players in this family court case, like prisoners of war.

During one of these hearings, the Rucki children sat in a conference room for several hours before being addressed by the court – during that time Dr. Gilbertson witnessed that the children were “anxious” and “apprehensive”. Dr. Gilbertson also noted that the Rucki children wanted – of their own free will – to have a say in what happens to them. In response, Dr. Gilbertson admitted to giving the children “factual knowledge” about the case – i.e. feeding information to influence them. Dr. Gilbertson also noted that he children make requests to see their mother, but not their father.

The child who authored this diary entry was subjected to reunification therapy which involved breaking down the child’s will in order to suppress memories of abuse, so with a “blank slate” the child could be programmed to accept a relationship with an identified abuser. This is why reunification therapy is also referred to as “de-programming” – the child is actually being told what to think, believe and feel.

S.R. has made various statements indicating this has happened – stating the therapist and the Guardian ad Litem gave her false information, and specifically made negative comments about her mother in an attempt to influence her. S.R. also says that when she spoke about abuse she was called a liar and told that she needed “de-programming”. Dr. Gilbertson has admitted that “therapy” also included explaining to the Rucki children why they could not see their mother.

Instead of identifying the cause of that fear, Dr. Gilbertson’s treatment involved “exposing them to the object they fear” i.e. father, in order to “desensitize” them.Dr. Gilbertson asked that GAL Julie Friedrich clear her schedule to plan for a 2 hour session to “desensitize” the Rucki children. Dr. Gilbertson is talking about holding 5 frightened children in a room inside the courthouse with a bailiff guarding the door, and using the authority of the court to force these children to recant abuse allegations, and develop a bond with an identified abuser who they are terrified of. Let’s be clear – this is not “therapy”, it is psychological torture. The methods Dr. Gilbertson used on the Rucki children do not meet the standards of trauma based therapy, and certainly no credible psychologist would attempt “therapy” on 5 children all at one time, failing to address or consider the individual needs of each child.

After S.R. and G.R. ran away, reunification therapy continued with the 2 younger children. Reports written AFTER the events of April 19, 2013, indicate the child who authored this post continued in reunification therapy and continued to showed fear of Rucki. The child also would leave the room when Rucki entered and avoided physical contact with him. Similarly,  investigative reports showed similar behaviors present in S.R. and G.R. Witnesses who interacted with the sisters during the time they stayed on the Ranch, recalled they were fearful, avoided physical contact, and spoke about abuse (see Dahlen investigative report below). These types of emotional and behavioral reactions are common with children who have experienced abuse and trauma; yet Dr. Gilbertson completely ignored all evidence and information suggesting abuse had occurred, and worked to intimidate the Rucki children even as they are crying out for help. 

The diary entry you are about to read is the voice of a child who may not even exist anymore – reunification therapy forces a child to suppress who they really are, and become a child the court approves of. There is no success in treatments like these, the relationship that results is not one of love or trust, but instead a relationship based on trauma bonding.

Despite all this child has had to endure, they also show incredible courage in posting a family photo taken with Sandra. A playful image shows laughter, and demonstrates the closeness once shared….

Sandra Grazzini-Rucki and children continue to be estranged due to the forcible actions of the court, and due the actions of a dangerous abuser. Photographs and perhaps a few stubborn memories that have resisted “de-programming”, are all they have to hold onto each other.

On September 7, 2012, Judge Knutson said an emergency required him to remove the five children from their mother’s care. He said mother had the condition of Parental Alienation syndrome (PAS). That condition is based on the theory that if a child dislikes a parent, the cause is the other parent.
He appointed a therapist, Dr. James Gilbertson, to “re-program” the children to like their father. The children say their father has abused them and their mother.
At a conference on February 26, 2013, two of the children told the judge the following:

“I am 14 and in June I will be 15.I am here today to say a few thing to not only you but Ms. Friedrich and Dr. Gilbertson.
“I would first like to say I am appalled by the way this court has treated me and my brothers and sisters.
I have not only been called fat a number of times by Julie Friedrich but have been ask if I was pregnant and been called a down right liar by not only Ms. Friedrich but also Dr. Gilbertson. I’m not only disgusted be the way they talk to me, my brothers and sister, but pissed at the way this court has accuse me of being a liar. I’m 14 and in a couple of months I will be 15. I know the difference between a lie and the truth.
I stand here today to tell you the truth about my father. To begin with, he has not only told my family that he is homicidal, but sat us down at kitchen table and yelled at us saying that he was not only going to kill me but my brothers, sister and mom. Not even a week later I received a horrifying voicemail of 6 gunshots. He has also choked, slapped, and hit and verbally abused my mother repeatedly throughout their. marriage. He also has lost it on us kids more than a number of time physically and verbally. Also he has made sexual comments to me over the year about my boobs look bigger and so forth and over the year many of my friends could not hang out with me because of my father. The day my father officially moved out of the Ireland place home was not only a day of peace and happiness but safety in the household.
“And second I would like to say it was absolutely absurd of you to remove us from our mom’s care. She has been nothing but loving and our rock and you not only removing us from us from her but not letting have contact with her for 6 months, 19 days except for the one 3 hour meeting on January 11. It is down right cruel, ruthless of this court. I ask you to let me live with my mom, let me be happy because all this courtroom has done has cause misery and heartache. Thank you for your time.”

My father has frightened and hurt my family. After the divorce was final, my father kept repeatedly threatening and shocking myself and my bothers and sister and my mother. I have been called a liar and have not been able to say what I believe without a court member discriminating me.
I wish to be with my mother, because my father has brought nothing but pure torture to my family.”
Julie Friedrich is the court appointed guardian ad litem. Sandra Grazzini-Rucki filed a complaint against the Guardian ad Litem, the Minnesota State Guardian ad Litem Board has never formally investigated her complaint or taken any action against either GAL involved – Julie Friedrich, and Laura Miles.

Judge Karen Asphaug: 6 Years for Sandra Grazzini-Rucki, 60 Days for MMA Fighter Who Brutally Beat Wife

Dakota County Judge Karen Asphaug, along with County Attorney Jim Backstrom, endorsed a much harsher sentence for Sandra Grazzini-Rucki, a domestic violence survivor who assisted her children from running away from an environment they felt was unsafe, than a sentence (previously) issued to Brett Rogers, a MMA Fighter who brutally beat his wife in front of their two terrified children.

 

Cruel & Unusual Punishment: Grazzini-Rucki Case

Ironically, the escalation of the Grazzini-Rucki divorce, and the Brett Rogers assault both occurred in June 2011. However, the way these two cases were handled by Judge Asphaug, and Jim Backstrom couldn’t be more different.

In 2011, Sandra Grazzini-Rucki divorced an abusive husband, David Rucki, and sought to rebuild her life, and that of her children. In family court, she entered a legal minefield that would leave her homeless, without children, and financially devastated. Even worse, Judge David Knutson, and the court professionals, refused to listen to abuse allegations raised by Sandra and the children; even as Rucki continued to stalk and terrorize the family.  The failures of the court system, Judge Knutson specifically, and the mishandling of abuse allegations created a crisis that resulted in Sandra being in jail today, convicted of felony deprivation of parental rights.

By all counts, the interventions of Judge Knutson, and the family court professionals, had a traumatic and disastrous effect on the Grazzini-Rucki family, especially the children. Judge Knutson dismissed concerns of abuse and pushed for reunification even as David Rucki was violating protective orders, and his children expressed fear of him due to his violent behavior. It was the opinion of court-appointed therapist Dr. Gilbertson that the children needed to be “desensitized” to the “object of their fear, father” and that by forcing a face-to-face visit, and forcing the children to sit in during court hearings would facilitate a better relationship with their father. Instead, the Court’s actions increased the children’s fear, especially when Rucki was not held accountable for his abuse – such as violating a no-contact order with the children, and chasing one of the children (and her friends) down the street.In September 2012, Sandra was forcibly removed from her home, and from her children’s lives – the children begged to live with their mother, their cries went unheard.

In April 2o13, the situation had escalated to a crisis, when Judge Knutson ruled that the children would be placed in the temporary custody of David Rucki’s sister (and by extension, the children would be under his control, as the aunt maintained frequent contact, and followed his direction). The children expressed they did not feel safe with the aunt, and raised allegations that she mistreated them. In April 2013; after the courts failed to protect them from abuse, two of the Rucki girls ran away. In a panic, the girls called Sandra, begging for help. Sandra admits to helping them, stating, “I did what any parent would do… protect them from harm“. The runaway Rucki girls went missing for two years before being found in November 2015, living on a therapeutic horse ranch with a couple who specializes in working with vulnerable, at-risk children.  Criminal charges against those involved in their disappearance, including Sandra, followed.

In July 2016, Sandra’s criminal trial was held before Judge Asphaug at the Dakota County Judicial Center.  During trial, Sandra raised the affirmative defense, meaning her actions were taken to protect her children from physical or substantial emotional harm. Judge Asphaug suppressed 75% of defense evidence, meaning the jury did not hear a majority of evidence proving abuse, and did not hear from several witnesses, and a domestic violence expert who would have been called.  Further, to raise the affirmative defense, Sandra had to prove, “the person reasonably believed the action taken was necessary to protect the child from physical or sexual assault or substantial emotional harm..” Withholding evidence, and limiting what the defense could present, did not allow the Defense to present context in which Sandra acted, and her state of mind or “reasonable belief” could  to the jury.  Allegations of prosecutorial misconduct have also been raised as contributing to Sandra’s conviction. Critics argue Sandra’s trial was “rigged” and set up to fail.

Subsequently, Sandra was found guilty on six felony counts of deprivation of parental rights, and sentenced in September 2016.  With time served, Sandra was expected to serve no more than one year and one day in jail.

However, Prosecutor Kathryn M. Keena wanted to give Sandra an aggravated sentence, meaning harsher than the law allowed. Aggravated sentences are usually reserved for the most severe crimes – drug smuggling, repeat offenders, serial killers etc. Since Sandra’s case did not meet the standards necessary to impose an aggravated sentence, Judge Asphaug manipulated the legal system to stretch out the sentence to involve short jail stays stretching over 6 years. The sentence also includes yearly stints in sentence to serve and 6 years of probation as well as hefty fines. Failure to meet the conditions of probation could result in additional jail time. Sandra filed a motion to execute her sentence, meaning spend all of her time in jail up front, and avoid probation. That motion was denied by Judge Asphaug in October 2016.  What is being done to Sandra is clearly is cruel and unusual punishment – the punishment is more severe than the crime merits, and will cause undue hardship that will challenge Sandra’s ability to re-enter society (for example – it is difficult enough for a felon to gain employment, let alone a person with 6 felonies, and who is required to return to jail every year AND if she fails to perform sentence to serve, additional jail time will be issued).

The unusual harshness of Sandra’s punishment, is more clearly seen when comparing this case to another criminal case, involving domestic violence, that was also presided over by Judge Asphaug. This case differs in that it involves a perpetrator, found guilty of a violent crime, who received a plea deal and even after re-offending, avoided the wrath Judge Asphaug has inflicted on Sandra.

Brett Rogers: “Night of Horror”

Compare  Judge Asphaug’s harsh treatment of Sandra Grazini-Rucki to the sentence imposed on Brett Rogers for domestic assault, and you will see a man who brutally beat his wife was given a more lenient sentence than a mother who sought to protect her children from abuse.

In November 2011, Brett “Da Grim” Rogers, a heavyweight mixed martial artist, was sentenced to 60 days in jail after brutally beating his wife, T.R., in front of his two daughters. Judge Asphaug described the incident as a “night of horror“. With time served, Rogers would serve no more than 2 weeks in jail.

The incident happened on June 28th, a neighbor called police after witnessing Rogers punch his wife, T.R., as she lay on the ground outside their house. The neighbor noticed blood was streaming down her face. During the attack, T.R.  lost consciousness. T.R. sustained multiple injuries including a broken jaw, a tooth was knocked out, a “golf ball size lump” above her eyebrow, among other injuries. Rogers said the assault was just a “misunderstanding“.

The two children reported that they were afraid to go home, and that their father had previously choked them. One of the children attempted to intervene, but was helpless to save her mother. The children spent the night at a neighbor’s home while their mother was rushed to the hospital.

Rogers plead guilty to felony third-degree assault. As part of a plea deal, two felonies of domestic assault by strangulation and stalking were dismissed, as well as a gross misdemeanor charge of endangering a child. Rogers was also ordered to 3 years probation, and to complete a domestic abuse program. Jim Backstrom was instrumental in the deal offered to Rogers.

Rogers violated the conditions of his probation just a few weeks after release by contacting T.R., and by pushing a man at a local restaurant. Several other charges were to follow over the following years… probation violations, violations to a no-contact order, felony domestic assault and DWI. Rogers has struggled to rebuild his life, though he claims he will be a better man.

Both of these cases were presided by  Judge Asphaug, and both involve incidents related to domestic violence. Domestic violence has significantly affected both families, and their children in different ways. The resulting criminal charges against is indicative of Judge Asphaug’s personal views of their circumstances (including her knowledge or understanding of domestic violence), and perception of the offender – and suggests her sentencing of Sandra may be motivated by a political agenda, because it is so radically beyond the usual sentence imposed. And so beyond even the sentence given to a domestic abuse offender.

After convicted of a violent assault, even after re-offending, and continued legal troubles, Brett Rogers has served minimal jail time. He continues to fight professionally. And is allowed to have contact with his children. He is moving on with his life.

Sandra Grazzini-Rucki has no previous criminal history, and was given extensive jail time and probation (with no possibility of early release) though her crime was not violent in nature, and she poses no harm to anyone. What makes the jail time extensive, and the punishment unusual is that Judge Asphaug has manipulated the legal system to extend the sentence far beyond what the law normally allows.  Some speculate that Judge Asphaug, and Dakota County, will continue to find ways to punish Sandra, even find reasons to jail her long after her time has been served.

Brett Rogers, found guilty of felony assault, who is alleged to have abused his own children, and has a lengthy criminal history has been given a lesser sentence, even after re-offending than Sandra Grazzini-Rucki, an abuse victim who fought to protect her children legally. When the court system failed, Sandra was forced to make an agonizing choice that ultimately resulted in complete estrangement from her children, and now a felony conviction resulting in jail time.
